What do you think of the AP copyright infringement allegation against Shepard Fairey?
A comparison showing Mannie Garcia’s photograph of Obama next to Shepard Fairey’s ‘Progress’ and ‘Hope’ posters. The portrait of Obama by Shepard Fairey is a stencil portrait. Fairey created a stencil over a scanned and enlarged version of the photograph that was slightly tilted according to various articles. Fairey and a gallery that represents him has stated that he did in fact use the Garcia photograph as the base image for his Obama posters according to news articles. The Assosicated Press claims to own the copyright to Garcia's photograph and desire compensation from Shepard Fairey. Fairey's lawyer states that Fairey did nothing wrong and that is use of the image falls under fair use. Do you think his use of the image falls under fair use? Since the photograph itself is not widely known some lawyers have suggested that Fairey's use does not fall under fair use. In order for it to be fair use there must be a dialogue between the old work and the new work that is obvious to the viewer-- obvious to the majority of the public. Unfortunatey for Shepard the majority of people, including Garcia and the AP, did not make the connection between Garcia's photograph and Fairey's Obama posters. So did Fairey fail at fair use? If so, did he willfully infringe on the photograph?
I have posted several articles about Shepard Fairey and fair use that might be of interest to some of you. My thoughts, http://www.myartspace.com/blog/2009/02/art-law-professionals-weigh-in-on.html

I've been looking up my images one by one and for some reason TinEye lists every single one as also being on a romanian site called psychocreature.ru. It takes forever to load and the images appear to be intact and not being offered for sale...anyone else have this experience or know what it might mean?

While searching for anything of mine (got one, so far, grr), on Photobucket, I came across a user that has a huge folder full of work I recognise. The only one I can put a name to is Michele-lee Phelan, and Zancan from DA, a lot of the names have been removed from the filenames.
Can anyone put names to these and let the artists know?http://s64.photobucket.com/albums/h182/bonnie_anna92/anime/

I noticed they have alot of people's artwork especially in the "dark gothic" section. You might want to take a look.http://www.satanspace.com/
They make this claim at the top: NOTE: A lot of these images are submitted by fans and I have no way of knowing where they originally come from, so if you own one please let me know and I'll either link to you under it, add your copyright to the image, or take it down at your request.
and you can contact them here: http://www.satanspace.com/contact/

One of those horrible, bad graphics, dodgy myspace layout sites ripping some of just about everyones work ever...http://hotprofileplus.comSo far I've found-
Stephanie Pui-mun Law
Lots of work from random DA photomanipluators (some using my stock photos, as how I recognised them)
Beware when browsing for all the pop up ads (oh god the poor taste of the site almost overwhelmed me!)
And I can't seem to find any contact info whatsoever... Anyone have any suggestings on nailing these buggers?
I'm in a completely non-tolerating mood right for this crap right now...

Some one creating illegal copies of artworks
I've already had mine removed, but there is also Suzanne Richards, Sarah Pauline, and two other artworks that look familiar but I can't place just at the moment. They are just doing DIRECT copies of everyones artworks in Pen and ink and selling them.
The seller emailed me after ending the copy of mine and asked HOW she was in violation, and said she didn't do them herself, she was selling them for someone else.... shyeah....
One to keep an eye on, there's already been a new one added which looks like another copy since mine was ended...

Does anyone know any direct contact information for some one at Second Life www.secondlife.com
that handles copyright infringement?
Their website is very poorly lacking in the subject, and only one lame contact form that I worry won't receive any attention.
Margaret Dean, who got it from J Corsentino I beleive, forwarded me some screen shots of a "gallery" selling stacks of my artwork, plus theirs, as well as Julie Fains, Amy Edwards, many others. Sales in game can be made into real life money from what I hear.
I really don't want to have to sign up to and download this game... but it looks like a whole new world of copyright infringer playgrounds...
Anyone ON second life already, the co-ordinates for this gallery are Doomaekkot (196, 8, 42) (not even sure what that means but it's all I got)
